These Terms of Use (“Terms”) govern your use of the Zelest mobile application (“App”) and related services. By downloading, installing, or using the App, you agree to these Terms.
1. Service Description
Zelest is a mobile application that offers an AI-powered personal astrology experience. Our services include:
- Birth chart analysis: Natal chart calculations and interpretations
- Transit analysis: Interpretation of planetary transits’ personal effects
- Synastry: Astrological compatibility analysis between two people
- Daily horoscope readings: AI-generated personalized daily interpretations
- Push notifications: Astrological events and personalized alerts
Zelest uses astronomical data for astrological calculations and artificial intelligence technology (Claude AI) for interpretations.
2. User Account
2.1 Account Creation
- You must create an account to use the App.
- You are required to provide accurate and current information during registration.
- Individuals under the age of 13 cannot create an account.
2.2 Account Security
- You are responsible for the confidentiality of your account credentials.
- You are responsible for all activities performed through your account.
- You must notify us immediately if you notice unauthorized access.
2.3 Account Deletion
- You may delete your account at any time through the in-app settings or by emailing us.
- When your account is deleted, all your personal data will be permanently removed within 30 days.
3. Subscription and Payment Terms
3.1 Subscription Plans
Zelest offers the following subscription options:
- Weekly subscription: 7-day access
- Monthly subscription: 30-day access
- Yearly subscription: 365-day access
3.2 Free Content
Some basic features are offered for free. Access to premium features requires an active subscription.
3.3 Payment
- Payments are processed via in-app purchase through the Apple App Store or Google Play Store.
- Prices are displayed within the app and may vary based on your region.
- All prices include applicable taxes.
3.4 Auto-Renewal
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- The renewal fee will be charged to your account within 24 hours before the current period expires.
3.5 Cancellation
- You can cancel your subscription at any time through your device settings (App Store / Google Play).
- After cancellation, you will continue to have access to premium features until the end of your current subscription period.
4. Intellectual Property Rights
4.1 Zelest’s Rights
- The App, its design, logo, content structure, and software belong to Zelest.
- All content, including AI-generated interpretations, is protected by copyright.
- The Zelest brand and related trademarks are registered.
4.2 User Content
- Birth information and other personal data you enter into the App belong to you.
- We have the right to use this data solely for the purpose of providing the service.
5. Usage Restrictions
The following behaviors are strictly prohibited:
- Reverse engineering the App’s source code
- Copying, distributing, or selling any part of the App
- Using automated bots, scrapers, or similar tools
- Gaining unauthorized access to other users’ accounts
- Performing actions that could damage the App’s infrastructure
- Creating accounts with false or misleading information
- Using the App for illegal purposes
Violation of these rules may result in your account being suspended or deleted without notice.
6. Limitation of Liability
6.1 Astrological Content Disclaimer
IMPORTANT: All astrological interpretations and analyses provided by Zelest are offered solely for entertainment and personal development purposes. This content:
- Is not medical advice. Consult a healthcare professional for health decisions.
- Is not financial advice. Seek expert advisors for investment and financial decisions.
- Is not legal advice. Consult a lawyer for legal matters.
- Does not replace psychological treatment. Seek professional support for mental health concerns.
6.2 Service Warranty Limitation
- Zelest is provided “as is.”
- We do not guarantee that the service will operate without interruption or error.
- Temporary access issues may occur due to technical failures, maintenance, or third-party service outages.
- The accuracy or completeness of AI-generated interpretations is not guaranteed.
6.3 Damage Limitation
Zelest is not liable for indirect, incidental, special, or punitive damages arising from the use of the App. Our total liability shall not exceed the subscription fees you have paid in the last 12 months.
7. Service Changes and Termination
7.1 Changes
- Zelest reserves the right to add new features to the App, modify or remove existing features.
- You will be notified in advance about significant changes.
- Price changes will not affect your current subscription period.
7.2 Termination
- Zelest has the right to suspend or terminate the accounts of users who violate these Terms.
- If the service is completely discontinued, refunds will be issued for the remaining period of active subscriptions.
8. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the Republic of Turkey.
- The courts and enforcement offices of Istanbul shall have jurisdiction over the resolution of disputes.
- Your consumer rights are reserved, and you have the right to apply to Consumer Arbitration Committees and Consumer Courts.
9. General Provisions
- These Terms constitute the entire agreement between Zelest and the user.
- The invalidity of any provision shall not affect the other provisions.
- Zelest’s failure to exercise any right does not constitute a waiver of that right.
- These Terms may be updated from time to time. Significant changes will be announced via in-app notification.
